What to do if a Medical Practitioner is Harassed?

Introduction Medical Practitioners face a high and elevated risk of violence against them all over the world. According to a study by World Health Organization (WHO), up to 38% of Medical Practitioners face violence at some stage of their career. Furthermore, a larger section of medical practitioners faces verbal aggression more pervasively. The aggressive parties in such cases are mostly patients or families of affected patients, for whose benefit the practitioner works in the first place. Many patients, bereft of basic principles of emotional management in stress-inducing situations, resort to violence, creating a problem that needs to be addressed on a global scale. This article seeks to explore the phenomenon of harassing medical staff and the subsequent legal remedies available to the victims of such harassment. Read on! Forms of Abuse Increase in violence against medical professionals can happen due to war, or situations of an extreme health scare, such as pandemics, and epidemics, as well as due to scarcity of adequate healthcare resources that instigates violence against healthcare workers and professionals. Other factors that lead to violence may include aspects such as friction in the workplace, farcical compliance measures, lack of socially appropriate response against wrongdoers, and lack of adequate remedies to protect the victims of such violence, i.e. the doctors. Furthermore, sometimes, healthcare professionals are threatened by coercion and threats to work against principles of ethics, which is categorized as a form of violence. Factors such as pandemics can also factor in various states of aggression against doctors and healthcare professionals. However, generally, violence against healthcare professionals manifests in the form of verbal or physical abuse and mental harassment. According to a report entitled, “Violence Against Healthcare: Current Practices to Prevent, Reduce or Mitigate Violence against Healthcare”, released jointly by the World Medical Association, in collaboration with ICRC, Geneva. International Council of Nurses, & International Hospital Federation, violence against healthcare professionals can be classified under the below mentioned following three categories- Verbal Abuse Physical Abuse Mental Harassment Verbal Abuse: Includes instances of verbal aggression by the patients, or the relatives or family of patients, verbal threats to the health-care provider or other ancillary staff, with the World Medical Association stating that 100% of those surveyed had experienced some form of verbal aggression by the patients, and almost 82% of the surveyed, having experienced verbal threats from aggressive patients. Physical Abuse: Includes instances of hitting a healthcare professional either directly, or with the aid of a weapon or object, which leads to severe psychological effects for the healthcare worker. The World Medical Association stated that 82% of those surveyed had experienced some form of physical aggression by the patients, and almost 27% of the surveyed were targeted with dangerous weapons and were also targeted with shelling, stones, and arson to property. There have also been instances wherein the consequences have led to severely wounding or killing the healthcare professional. Mental Harassment: Many doctors and health care professionals, as well as supporting staff such as nurses, midwives, etc. have also experienced instances wherein they were stopped from performing their duty by obstruction of care by the patients and families continuously stonewalling the efforts of the professionals in the required course of medication and treatment, which leads to mental distress to the professionals. Judicial Pronouncements In the case of Arun P. v. State of Kerala (2022), it was held that granting bail before arrest to a persona alleged to have committed acts of violence against doctors, would send a wrong message, also stating that even the absence of assault does not entail a person accused of violence against doctors to pre-arrest bail. Further, in September 2022, the Supreme Court admitted a petition to hear a plea on violence against healthcare workers. In this case, Indian Medical Association (Dwarka) filed a Public Interest Litigation (PIL) at the Supreme Court in order to develop a mechanism for compensating the families and dependents of doctors who have passed away and to obtain complete rules for their protection. However, at present, there is no substantive law or central legislation providing an all-comprehensive and holistic outlook for dealing with punitive, preventive and compensatory measures to address issues of violence against healthcare workers in India, and thus the legislative pronouncements do not present a unified stand on punishment, compensation, etc. which varies on a case to case basis. Anticipating Doctor’s Rights Doctors have various rights, howsoever, in the present scenario, it is imperative to ensure general security-related measures, such as increasing security calls for the deployment of effective security personnel. Additionally, additional security staff hiring as well as organizational adjustments have been mentioned. The quickness of the security staff's intervention is of the utmost significance, thus they must be responsive and accessible in case of an emergency. To ensure a prompt response to occurrences, the health facility's security focal points must be engaged. If necessary, security personnel from a nearby neighbourhood or from outside the facility can step in to help with in-house security. Last but not least, possible attackers may be discouraged by visible identification of health staff inside the institution (with, for example, newly designated jackets) and signage on the facility itself (such as a "no weapons permitted" sign). Some of the pertinent actions that can help in anticipating the rights of the doctors in a timely manner can include securing high-risk areas with access control, securing the spaces around the facility, assessing risk and performing risk assessment around the health facility to understand the risks involved, further actions would include analyzing the reported cases of violence against healthcare professionals, and proper staff training. Where to Complain? In the Indian context, violence against healthcare professionals has been categorized as a criminal offence and falls under the ambit of the concerned state/UT, which punishes the offenders under relevant provisions of the Indian Penal Code & Code of Criminal Procedure, with the objective of ensuring that doctors and healthcare professionals can function without the constant looming threat of fear or violence. Furthermore, The Epidemic Diseases (Amendment) Act, 2000, notified by the Indian Government on September 28, 2020, in response to the COVID-19 epidemic, stated that according to the amended act, acts of violence committed against medical staff in circumstances similar to the present epidemic would be crimes that are both cognizable and non-bailable in nature. Thus, a complaint can be made in any police station that falls within the jurisdiction of the concerned state and charge sheet shall be filed by the police officials in this regard, following which the proceedings shall ensue in court. How to Seek Compensation The commission or facilitation of such violent crimes is punishable by imprisonment for a period of three months to five years and a fine ranging from Rs. 50,000 to Rs. 2,00,000. If you injure someone severely, you could be imprisoned for six months to seven years and fined between Rs. 1 lakh and Rs. 5 lakh. The offender will also be responsible for paying double the fair market value for property damage in addition to compensating the victim. This compensation can usually be sought from and granted by the courts in the Indian context. Other Remedies The Union Ministry of Health & Family Welfare has, in order to prevent violence against doctors and for inculcating an effective sense of security among the doctors on duty, taken several measures including issuing advisories in this regard to all States/Union Territories (UTs) to consider the following- Ensuring a Trained & Designated Force to ensure security for hospitals CCTV Camera Installation so as to ensure round-the-clock monitoring that can provide evidence in case of instances of violence Centralized Control Room and Helpline to assist the Healthcare Professionals and those affected. Complete Ban/Restriction on Entry of Wrongdoers to ensure the safety of the healthcare professionals. Immediate filing of FIR against assaulters in question Appointment of a Nodal Officer, a Grievance Redress Mechanism The Ministry of Health and Family Welfare has repeatedly emphasized the need to protect the safety and security of healthcare personnel at their living/working premises through formal communications as well as more recently through video conferencing with States and UTs. Conclusion Any form of violence against health workers is uncalled for and unacceptable at all levels. It affects the morale and work ethics of healthcare professionals, as well as affecting their job motivation. Instances of such violence also end up with a dangerous compromise on the standards of treatment and health care provided due to friction between stakeholders. In light of the same, there is a need for intervention in order to prevent violence against healthcare professionals and take every possible effort to ensure the effective management of potentially violent patients as well as high-risk visitors in hospitals. Only such measures shall ensure a safer environment for the hands that aid and cure us and form the backbone of the most crucial facet of human life health.

Mental Healthcare For Doctors In India

Arguably, it can be said that the medical profession is one of the most challenging professions across the globe. While there is a high degree of personal satisfaction involved, working in this profession also involves an extremely high threshold of responsibility and accountability. For the past several years, and especially in the recent pandemic-affected years, the mental health of healthcare workers has been a growing concern. This is primarily owing to the fact that the medical profession itself entails a number of stress factors which may adversely affect the physical, mental, and emotional well-being of such professionals in a number of ways. This article aims to explore the mental condition of healthcare workers in India and the need for a new approach and corrective measures. Read on! Major Mental Health Issues Primarily, there are 3 primary mental health issues that usually tend to affect healthcare workers: Stress- Stress can be defined as any type of change that causes physical, emotional, or psychological strain. In other words, stress is our body's response to anything that requires attention or action. Depression- Depression is a mood disorder that causes a persistent feeling of sadness and loss of interest. Also called a major depressive disorder or clinical depression, it affects how we feel, think and behave and can lead to a variety of emotional and physical problems. Burnout- Burnout is a reaction to prolonged or chronic job stress. It is characterized by three main dimensions: exhaustion, cynicism (less identification with the job), and feelings of reduced professional ability. More simply put, if an individual begins to feel exhausted, starts to hate his/her job, and begins to feel less capable at work, he/she is showing signs of burnout. Common Causes Of Mental Problems In Healthcare Workers Understaffing- Understaffing is one of the major issues faced by healthcare institutions in India- especially government medical institutions where the recruitment process is potentially incompetent, slow or corrupt. Understaffing in a healthcare centre essentially leads to ambiguity in work roles and additional workloads for healthcare workers who already have their plates full in their current rules. It also adds to operational management which creates further stress. A lack of resources- A work environment that is lacking in the necessary resources, especially one that pertains to the invaluable commodity of human life can cause severe stress to professionals. It is important to keep a healthcare institution well-equipped with regard to the services being offered as well as potential contingencies. Challenging patients and relatives- Medical professionals such as doctors and nurses, in addition to their usual work, also have to interact with patients, patients' families and relatives on a regular basis. While this is usually to consult or update the family on the condition of the patient, sometimes this interaction may also involve breaking the bad news of the deterioration or demise of a patient. In such cases, the patient’s family may often react in a violent or hysteric manner. Even if there is no fault of the doctor involved, they feel excessively stressed and guilty for the loss of their patient. A lack of sufficient training or skills Shift patterns- Erratic shift patterns and the lack of rest resulting from it often adds to the stress threshold of a doctor. Back-to-back shifts which together span over 20 hours is an inhumane but apparent necessity that plagues the medical profession. Heavy workloads- Most roles in the medical sector usually involve consistently heavy workloads and strict deadlines that make work notoriously challenging and hard to keep up with. Moreover, there is no possibility of rushing through the work owing to the high standard of care and due diligence involved. Long shifts- Long shifts, while unhealthy, are common in the medical profession and eventually lead to systematic sleep deprivation in healthcare workers. In 2010, the Supreme Court ruled that medical residents must now work for more than 12 hours at a stretch and more than 48 hours a week- this is yet to be implemented comprehensively as medical students and young medical professionals continue to be the subject of exploitation at work. Unsociable hours- In addition to long shifts, medical professionals often have to observe unprecedented and unsociable work hours. Being called in on an emergency even on an off day is a common occurrence in government as well as private hospitals and health centres. Poor working relationships- The work environment is an important factor that influences the way a doctor or nurse handles stress at the workplace. When there are poor working relationships, the overall job of the professional becomes significantly more tedious as compared to a scenario where the co-workers are on friendly terms. Dealing with death- Regrettably, death is an inalienable part of a doctor’s work and even though one might encounter such patient deaths a few times in one’s career, it is difficult to cope each time. This is why in some Western healthcare institutions, counselling is made mandatory for a doctor after the demise of his/her patient in order to assist the professional in overcoming the setback. The stress resulting from these factors further results in untoward consequences in junior doctors and other young medical professionals through: Prescription errors or errors in patient care Losing temper with patients/caregivers Demonstrating an inability to give sufficient time/attention to their patients Experiencing poor communication skills, and- Feeling a lack of empathy for their seniors. The Chandigarh Survey Needless to say, the highly volatile situation created by the Covid-pandemic which spanned almost two years was an immensely difficult time for medical professionals across the globe and more so in India, where the doctor-patient ratio is largely inadequate, thanks to a growing population of 140 crores in the country where there a limited number of medical colleges. One of the first surveys carried out on the subject was done by the Postgraduate Institute of Medical Education and Research in Chandigarh. The survey comprised questions pertaining to demographic and personal characteristics, substance use, depression, perceived stress, and burnout. The study was approved by the Ethics Committee of the institute, and participation in the survey was voluntary. Out of the 445 medical professionals who participated in the survey, 30.1% of individuals were found to have depression. Furthermore, it was found that 74 participants strongly believed ‘they were better off dead or of hurting themselves in some way’. Medical Professionals In Rural Areas Even today, the quality and extent of healthcare services available in urban India and rural India bear stark contrast with each other. The infrastructure is severely lacking, professionals are often insincere and another overall standard of services that can be availed is average at best and sub-par at worst. Though the existing infrastructural setup for providing health care in rural India is on the right track, the qualitative and quantitative availability of primary health care facilities is far less than the defined norms by the World Health Organization. Union Ministry of Health and Family Welfare figure of 2005 suggests a shortfall of 12% for sub-centres (existing 146,026), 16% for Primary Health Centers (PHCs) (existing 23,236) and 50% for Community Health Centers (CHCs) (existing 3346) than prescribed norms with 49.7%, 78% and 91.5% of sub-centres, PHCs and CHCs located in government buildings and rest in non-government buildings respectively requiring a figure of 60,762, 2948 and 205 additional buildings for sub centers, PHCs and CHCs respectively. Usually, the experiences of a medical professional working in rural India is characterised by the following: caring for patients in a context of uncertainty, fear, and anxiety; practical solutions through improvising and being resourceful; gaining community trust and cooperation; adapting to unrelenting pressures; and- reaffirming commitments. This was especially highlighted during the Covid-19 pandemic, during which rural doctors felt largely underprepared to tackle community transmission and manage patients who contracted the virus. The uncertainty from feeling isolated, in terms of access to credible information and resources, left doctors with feelings of fear and anxiety, and a sense of not being in control as multiple problems were encountered. These feelings were exacerbated by a lack of personal protective equipment (PPE), limited COVID?19 testing, rapid system changes, possible COVID-19-positive patients turning up unexpectedly, and the flood of media exposure. The scenario was a repeated for a second time Despite the coping strategies, the longer?term impacts on rural doctors and their adaptive resources are causes for concern. In fact, the lack of support for doctors and other medical professionals in some areas is truly alarming and warrants thorough introspection. Violence Against Medical Professionals For government hospitals and primary health centres across the country, particularly in West Bengal and Maharashtra, violence by patients’ relatives, local goons, political leaders and even police has been reported. Here, money is not the reason but anxiety, but long waiting periods, non-availability of crucial investigations, inordinate delay in referral, and unhygienic and extremely crowded conditions in the emergency and other wards are some of the reasons given. To make matters worse, the electronic and print media also do not have a real understanding of the challenges faced by doctors. A true reflection of the prevalent times would be the results of a study by the Indian Medical Association (IMA) which reports that 75 per cent of doctors in India have faced violence at some point of time in their life, and most of the time, it is verbal abuse. Emergency and ICU are the most violent venues and visiting hours are the most violent time. Therefore, for the average doctor who is treating several patients in a single day or shift, the consequences of having to work in constant fear of violence can be devastating for mental health and the overall welfare of the professional. A Guide To Mental Health For Doctors Developing A Support System Develop a support system of well-wishes from among family members, friends and peers who have similar mindsets and goals in life. Stay in touch with them via phone calls, texts or other channels. Remember, to receive support one must also be willing to lend support to others. Having people to rely on ensures that you will undergo significantly less stress in a critical situation. Remain Hydrated Drink a sufficient amount of water every day. With proper hydration, a law student may enjoy an improved mood and other mental health benefits. Getting The Required Shut-Eye Despite the hectic schedule, find the time to get sufficient rest- at least seven to eight hours of sleep each night. That will make sure you wake up feeling refreshed and ready to tackle any challenges that come your way. Staying As Active As Possible Exercising regularly is important to combat anxiety and depression. Furthermore, make a habit to attend social events and take advantage of any opportunities to build friendships. This ensures that medical professionals can stay active, grow their support network, and develop meaningful relationships with others. Do Not Hesitate To Seek Help Even if you are remotely concerned about how you have been feeling lately, reach out to a professional. Confiding in your friends or family is always good but at the end of the day, one must remember that they are not qualified to provide any real help. A professional will help you understand what you are going through and exactly how you can remedy that to the benefit of your mental health. Conclusion In conclusion, it may be reiterated that a significantly higher proportion of doctors in India experience a number of mental health ailments such as severe stress, depression and burnout. It is important now more than ever to rectify the institutional deficiencies and administrative shortcomings and establish a sustainable support system for doctors and nurses who have high-stress work profiles and hectic schedules. Moreover, at the institute level, there must be a screening of professionals' mental health at regular intervals and there must be a provision for conducting regular stress management workshops. In addition to this, primary health care in India needs to be re-evaluated as a matter of priority which warrants immediate and concrete reforms, otherwise, this tug of war between growth and human resource development remains will continue forever. As a developing country with the world’s second highest population, medical professionals have always been, and continue to remain, a formidable asset in our journey towards advancement and mental health is an important element in their well-being and competence.

Health Insurance Fraud And How To Avoid It

Health insurance is a contract wherein the insurance company commits to ensuring payment for medical costs if the insured becomes ill or has an accident that necessitates hospitalisation. Typically, insurance companies partner with top hospitals to offer cashless care to their insured customers. If the insurance provider does not have a relationship with the hospital, they compensate the insured for their out-of-pocket costs. The government also encourages the purchase of health insurance by offering an income tax deduction. The health insurance business in India has, traditionally, been regulated by the framework governing general insurance business as issued by the Insurance Regulatory and Development Authority of India (“IRDAI”) from time to time. Section 2 (6C) of the Insurance Act, 1938 defines Health Insurance Business as under: "health insurance business" means the effecting of contracts which provide for sickness benefits or medical, surgical or hospital expense benefits, whether in-patient or out-patient travel cover and personal accident cover. This article aims to explore how a health insurance policy works, what legal resources to take in case of insurance fraud and how you can avoid such a situation being a consumer. Read on! How Does A Health Insurance Policy Work? Health insurance, at its most basic level, works as a policy between an insurer and a policyholder, also referred to as a participant or beneficiary. In exchange for a recurring monthly payment, the insurer under this plan must pay all or a portion of the policyholder's medical expenses. Doctor visits, prescription medications, medical equipment, and procedures can all be included in medical costs. Insurance companies also bargain with medical care providers to reduce the cost of their services to policyholders. Participants in a plan may pay much more for services from providers outside of their insurance network under a network arrangement. Some in-network services may not be covered by insurers under certain circumstances, for example, if they are received without prior authorization. Individuals (“policyholders”) can leverage the benefits of health insurance by paying a premium amount at regular intervals over a tenure. To be protected under the same insurance plan for the rest of their lives, they can even select a health insurance plan with lifetime renewability. Examining the healthcare requirements of the individual and the family is the first step in obtaining health insurance. The cost of the health insurance premium and the sum assured can be estimated using this approach and the person's financial capacity. However, it is important to strike a balance between the health insurance policy's premium and coverage, as it is not wise to compromise on the coverage for a lower premium. However, due to certain issues, a policyholder may want to file a complaint against their respective health insurance company, and the issues may include: Rejection of Settling of Claims Unsatisfactory Payouts Negligence on the insurer’s part Denial of Policy Renewal Request Premium Hike Additional Policy Features costing more Mis-selling of Insurance Plans Starting with a complaint to the insurer directly, there are many avenues to address any dispute with a health insurance provider. It is possible to escalate the issue to the IRDAI if the resolution is unsatisfactory. A Civil Court or the Ombudsman can be contacted for further escalation of an unresolved dispute. Following are the ways through which you can register a complaint against your health insurance provider: Register a Complaint with the respective Health Insurance Company The policyholder should file their written complaint and any required supporting documentation to the appropriate insurance provider's grievance redressal officer, and they should then receive a written acknowledgement. The policy document and the official website of the insurance provider or IRDAI both must include the contact information. The insurance company must respond to the complaint within 15 days of receiving the receipt. You can then go on to submit a complaint with the IRDAI if they fail to do so or if you are not pleased with the response you received. Integrated Grievance Management System IRDAI has an integrated grievance management system (“IGMS”) for storing and tracking complaints or grievances relating to insurance (IGMS). All policyholders have centralised access to this system, which allows them to register and track complaints at any time. If policyholders are unable to contact the insurance provider directly, this mechanism is crucial in assisting them in filing grievances. Points to bear in mind while submitting a complaint to the IGMS: A complaint must be filed with the insurer first, and only if no action has been taken by the insurer may it be escalated to the IRDAI. A complaint filed in the IGMS will transit through the IRDAI repository and the insurer's system. The IRDAI has full access to and control over the IGMS. The system has precise Turnaround Time (TAT) targets for tracking complaint-related activity. Insurance Ombudsman The policyholder can seek help from the Insurance Ombudsman to raise an issue which is yet not been resolved by the respective insurance company. A policyholder may approach the Ombudsman with a complaint if: The policyholder first approached the respective insurance company with the complaint and (a) They have rejected it; (b) Not resolved it to their satisfaction; or (c) Not responded to it for 30 days Your complaint pertains to any policy you have taken in your capacity as an individual; and The value of the claim including expenses claimed is not above Rs 30 lakhs. The complaint may be about: Delay in settlement of claims, beyond the time specified in the regulations, framed under the IRDAI Act, 1999. Any partial or total repudiation of claims by the Life insurer, General insurer or Health insurer. Any dispute about premium paid or payable in terms of insurance policy Misrepresentation of policy terms and conditions at any time in the policy document or policy contract. The legal construction of insurance policies in so far as the dispute relates to claims. Policy servicing related grievances against insurers and their agents and intermediaries. Issuance of life insurance policy, general insurance policy including health insurance policy which is not in conformity with the proposal form submitted by the proposer. Non-issuance of insurance policy after receipt of premium in life insurance and general insurance including health insurance and Any other matter resulting from the violation of provisions of the Insurance Act, 1938 or the regulations, circulars, guidelines or instructions issued by the IRDAI from time to time or the terms and conditions of the policy contract, in so far as they relate to issues mentioned above. The claim was rejected by the deputy manager of the Insurance Company, against which Singh filed a complaint with the consumer forum alleging that the insurance company did not settle the Rs. 1 lakh claim after he filed the requisite documents (photocopies) regarding the hospitalisation of his wife who was admitted in a hospital. The District Consumer Disputes Redressal Forum by rejecting the argument of the Insurance Company that the claim has been preferred from 2 sources namely, MACT and this commission, held that both the remedies are independent of each other and that the Insurance Company could have procured the certified copy of the bills from MACT itself, and therefore held that the argument of the Insurance Company to negate the claim on the grounds of non-furnishing of the original bill fails by directing the Insurance Company to pay Rs. 1 Lakh claim to Singh.
